The opinion of European academics on the anti-counterfeiting trade agreement (ACAC) of 11 February 2011 was published in 2 JIPITEC 65 (2011). This opinion, signed by more than 25 European law professors and scientists specialising in this field, answers the following question: while it is indisputable that the violation of intellectual property rights, particularly on the internet, undermines the legitimate interests of rights holders, the question of whether ACTA`s standards of application are balanced remains highly controversial in Europe and abroad. The European Commission`s Trade Directorate has just published a document containing detailed comments on the opinion. In some circumstances, trade negotiations with a trading partner have been concluded, but have not yet been signed or ratified. MERCOSUR and the European Union have been negotiating a bi-regional free trade area since April 2000. Since 1995, relations between MERCOSUR and the EU have been inspired by the EU-MERCOSUR framework agreement, signed on 15 December 1995, which came into force on 1 July 1999. The agreement currently under negotiation consists of three components: political dialogue; Trade and economic issues and cooperation. The scope and objectives of the agreement were agreed at the first round of negotiations in April 2000 and at the Madrid Summit in May 2002. The EU and Central American countries reaffirmed their objective of concluding, at the EU-Latin America Summit in Guadalajara, Mexico, in May 2004 and at the EU-Central America Ministerial Meeting in Luxembourg, an association agreement comprising a free trade area, during which ministers welcomed the launch of a joint assessment of regional economic integration and the creation of a joint ad hoc working group in January 2005.
The aim of concluding a comprehensive association agreement was reaffirmed at the EU-Central America summit in Vienna in May 2006.
